How long does the insurance company have to pay the claim?
Under Florida law, Statute 627.428 the insurance company must pay your claim or deny it within 90 days of receiving your claim. They may pay a portion and deny a portion, depending upon the circumstances. The only exception to this is if a failure to pay is caused by reasonable factors outside the control of the insurance company. In any event, ORC Services will work with the insurance company to obtain full payment of your claim, and to minimize your out-of-pocket expenses. An exception to this is that in certain cases we will accept a 50% deposit from the customer to begin reconstruction while the insurance company decision remains pending. This would be to expedite completion of the work.
